On-line Sweepstakes - You must have Internet Access and a Valid E-mail Address to
participate in this promotion.
NO PURCHASE NECESSARY. Void in Puerto Rico and where prohibited by law. Purchasing a
product will not improve your chances of winning.
This contest requires participants to become a fan of the Welch’s Fruit Snacks® Facebook® page in order to be eligible for the prize. This sweepstakes will start on Monday, August 27th, 2012 at 12:00 PM., and will run until Thursday, February 28th, 2013, 11:59 AM. 1. Eligibility:
A) This Sweepstakes is open to residents of the 50 United States and the District of Columbia who are eighteen (18) years of age or older at the time the ”Charity Sweepstakes” (the “Sweepstakes”), begins. Employees of Promotion In Motion, Inc. (“Sponsor”), LaunchPad Media (“Administrator”), and their respective affiliates, subsidiaries, representatives, advertising, promotion and publicity agencies and the immediate families of each are not eligible. Sweepstakes is void where prohibited, restricted or taxed by law. All federal, state and local laws and regulations apply. B) This Sweepstakes is open to all current eligible fans of the Welch’s Fruit Snacks Facebook page. 2. Entry Period:
The Sweepstakes begins Monday, August 27th, 2012 at 12:00 PM., Eastern Standard Time (“EST”) and will run until T Thursday, February 28th, 2013, 11:59 AM. EST. (the “Entry Period”). 3. Entry:
To enter the Sweepstakes entrants (“Entrants”) must be a fan of the Welch’s Fruit Snacks page. To become a fan, log on to http://www.facebook.com/WelchsFruitSnacks, where you can click on the “Like button” and/or click on the Sweepstakes tab and complete the requested information. Entrants will be required to provide complete name, home address, telephone number, date of birth and valid E-mail address. Limit one Online Entry per E-mail address. Entries become the property of Sponsor and will not be returned. Sponsor assumes no responsibility for lost, late, incomplete, incorrect, or misdirected entries. Use of a false email account will disqualify an entry. Sponsor is not responsible for technical, hardware or software malfunctions, misdirected entries, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, lost, late, illegible, garbled, damaged or delayed electronic or other communications or other technical problems related to website entries. Sponsor, in its sole discretion, reserves the right to disqualify any person who tampers with the entry process or the operation of the web site, or who otherwise violates these rules. By entering, entrants accept and agree to abide by the terms of these Official Rules. 4. Prize Drawing:
Administrator is an independent judging organization whose decisions as to the administration and operation of the Sweepstakes and the selection of the potential winners are final and binding in all matters related to the Sweepstakes. Administrator will randomly select the potential Sweepstakes winner from all eligible entries received during the Entry Period, on or about March 2nd, 2013 The potential winner will be notified by email, mail, or telephone. Except where prohibited, the potential winner (parent/legal guardian if winners are under the age of thirteen (13) will be required to sign and return an Affidavit of Eligibility, Liability & Publicity Release (“Affidavit”), which must be received by Administrator within fourteen (14) days of the date notice or attempted notice is sent, in order to claim the prize. Acceptance of prize constitutes consent to the use of winner’s name, likenesses, and entries for editorial, publicity, and advertising purposes without further compensation. If the potential winners cannot be contacted, or fail to sign and return the Affidavit within the required time period, potential winners will forfeit the prize. Receiving a prize is contingent upon compliance with these Official Rules. In the event that the potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. 5. Prizes:
There is one (1) grand prize. One (1) grand prize winner will receive $5,000 and a donation of $5,000 made in their name to a charity or cause of their choice, subject to approval by Sponsor, in its sole discretion. There are twenty (20) weekly prizes. Twenty (20) randomly selected participants will receive Ten (10) boxes of Welch’s fruit Snacks. Retail value of $29.00. A) Odds of winning any prize depend upon the number of eligible entries in the Sweepstakes. B) Prizes are not transferable. No substitution of prizes for other goods and services is permitted, except Sponsor reserves the right to provide a substitute prize of approximately equal value. C) All prizes claimed in accordance with the Official Rules will be awarded. Winner may be required to provide a shipping address to claim prize. Allow 4-6 weeks for delivery of prize. 6. General Conditions:
A) By receipt of any prize, winners agree to release and hold harmless Sponsor, Administrator, and Facebook, Inc., and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize. B) Except where prohibited by law, participation in the Sweepstakes constitutes the winners’ consent to Sponsor’s and its agents’ use of winners’ names, likeness, photographs, voices, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. C) Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor reserves the right to cancel, modify, or suspend the Sweepstakes if in sponsor's sole determination it believes that the integrity of the Sweepstakes has been, or could be compromised or the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes. Sponsor reserves the right to disqualify any entrant from the Sweepstakes if in Sponsor's sole judgment entrant has not complied with these Official Rules. 7. Winners list:
A winners list will be available after winner is determined, verified and posted for approximately
two weeks. To receive a list of Winners, send a self-addressed, stamped #10 envelope to: “BTS
Sweepstakes Winners”, c/o LaunchPad Media, LLC, 100 Galen Street, Watertown, MA 02472.
